Child support proceedings in California are almost exclusively determined by using a computer software program that bases child support on the income of each party and the amount of time that each parent has custody of their children. Unfortunately, California’s child support guidelines are so complicated that they have earned unfavorable comparisons to the Internal Revenue Code’s taxation provisions.

Given the use of a complex formula to determine child support in California, a dispute regarding the calculation of child support is likely to focus on the numbers input into the program. In particular disputes will focus on the appropriate timeshare to use for each parent and, especially in the case of self-employed individuals or small business owners, on the appropriate income to be considered.
